Preliminary Note
Lima Confidence, sole proprietorship name: Owner: Ms. Lisa Dujmovits, located at: 2442 Unterwaltersdorf, Austria (hereinafter referred to as "CONTRACTOR") specializes in online trading of sports articles ("goods").
These General Terms and Conditions (hereinafter "GTC") govern the business transactions via the webshop at: https://lima-confidence.myshopify.com.
The customers are consumers within the meaning of § 1 Abs 1 Z 2 KSchG.
For better readability, gender-specific distinctions are omitted. This is without any discriminatory intent. All genders are equally addressed.
Scope of Application
All business relationships between the CONTRACTOR and the customer are subject to these GTC in their current version at the time of the contract conclusion. These GTC override any general terms and conditions of the customer.
Customers may permanently save and/or print these GTC for their online order.
The CONTRACTOR delivers goods to customers in Austria, Switzerland, and Germany. This is based on logistical, linguistic, and legal considerations, without any discrimination.
The contract, order, and business language is German.
Prerequisites for Use
To purchase goods electronically from the CONTRACTOR, customers may need to register in the online shop. The customer must provide truthful and complete information and keep their data up to date. They are responsible for keeping their data confidential and protecting it from unauthorized access. If the customer suspects misuse by third parties, they must inform the CONTRACTOR immediately.
The customer must refrain from any measures that could endanger or impair the technical operation of the online shop (including cyber-attacks).
Offer and Contract Conclusion
By clicking the "Order with obligation to pay" button, the customer makes a binding order to conclude a contract with the CONTRACTOR. The CONTRACTOR is not obliged to accept this order. Before submitting the final order, the customer has the opportunity to review and correct any errors.
The CONTRACTOR confirms receipt of an order via email to the address provided by the customer ("Order Confirmation"). This email does not constitute acceptance of the order.
The CONTRACTOR reserves the right to verify the feasibility of the order within three working days.
The CONTRACTOR can accept offers by confirming acceptance in a further email ("Order Acceptance") or by shipping the ordered goods. Only then does a contractual relationship with the customer come into effect.
The delivery time is indicated in the webshop.
If the CONTRACTOR is hindered from meeting the delivery deadline due to force majeure (e.g., natural disasters or epidemics) or supply shortages from third-party suppliers, they will inform the customer as soon as possible. In such cases, the delivery period is extended by the duration of the event.
Legal Capacity
When an order is placed via the webshop, the CONTRACTOR assumes that the customer has the necessary legal capacity to conclude the contract, can legally represent themselves, and is authorized to order (apparent authority).
Payment Terms
Prices listed in the webshop are in EUR.
In case of doubt, VAT may not be included. The applicable prices, taxes, and shipping costs are shown at the time of order. The CONTRACTOR will inform the customer again about prices, taxes, and shipping costs in the order summary before completing the purchase. Due to the small business regulation according to § 6 Abs 1 Z 27 UstG, the CONTRACTOR is VAT-exempt.

Shipping costs are borne by the customer.
